We need your help-Palmer Pointe legal action & fundraising

On August 29, 2013 and September 5, 2013 CODDER 02806, Inc. by its attorney, commenced legal action in the Superior Court, Rhode Island, against the Town of Barrington Planning Board and the East Bay Community Development Corporation (EBCDC) concerning the Planning Board’s  approval (with numerous attached conditions) of the Master Plan proposed by the EBCDC for construction of 50 rental housing units on 5.6 acres of developable land located on the Sowams Nursery property on Sowams Road in Barrington. 

 Our suit is based on state and municipal law which, in our judgment, and that of our lawyer, prohibits the proposed development. While the Planning Board Decision reduced the allowable number of rental units to 42, that still represents  a density of almost 8 units per acre in an R25 zone which both prohibits multi-family dwellings, and restricts the number of buildable housing units to 2 per acre.

As mentioned in previous public communications the process of final denial or approval of the EBCDC application is dependent on the conditions imposed by the Planning Board as well as extensive State and Municipal studies and analyses of the suitability of construction on the site.  We can now add to those qualifications our own lawsuit which challenges the proposed construction on a foundation of sound legal argument.
